This market will resolve to the U.S. state listed in the market options that is the first to enact a statewide data center moratorium after this market opens.
For purposes of this market, a “data center moratorium” means a state-level law, executive order, or other binding statewide government action that temporarily or permanently prohibits the approval, permitting, or construction of new data centers within that state.
A policy will not count as a moratorium if it only:
Ends, suspends, limits, or denies tax incentives for data centers;
Restricts state funding, subsidies, grants, or public financing for data centers;
Imposes reporting, study, disclosure, energy-use, water-use, or environmental-review requirements without prohibiting new construction;
Applies only to specific localities, counties, municipalities, zoning districts, or utility service areas rather than statewide;
Applies only to state-owned land or state-owned facilities;
Restricts only certain types of data centers unless the restriction effectively bars new data center construction statewide.
The market will resolve to the option corresponding to the first listed state in which such a statewide data center moratorium is enacted. Enactment means the measure has completed all legally required steps to become binding, including the governor’s signature, veto override, automatic enactment without signature, or valid executive action, as applicable under that state’s law.
If two or more listed states enact qualifying moratoriums on the same calendar day, this market will resolve to the state whose qualifying moratorium became legally effective first by timestamp. If the exact timestamp cannot be determined, the market will resolve 50/50 among the tied qualifying options, or according to the platform’s multiple-outcome tie policy.
If a listed state passes a bill through the legislature but it has not yet become legally binding, that alone will not count.
If a state not listed in the market options enacts a qualifying data center moratorium before any listed state does, this market will remain open unless otherwise specified, and will later resolve to the first listed state to enact a qualifying moratorium.
If none of the listed states enact a qualifying statewide data center moratorium by the market’s end date, this market will resolve according to the “No qualifying state” option if one exists. If no such option exists, the market will resolve according to the platform’s rules for unresolved or invalid markets.
The primary resolution source will be the official state government record, including enacted legislation, governor’s office announcements, state executive orders, state statutes, or official legislative records. Credible news reporting may be used to help identify relevant actions, but official state sources will control in the event of a conflict.
